FPL E-Mail Bill® Program $20 Gift Card Promotionand Bonus Chance to Win $5,000 CashOFFICIAL RULESThese Official Rules apply to the FPL E-Mail Bill® $20 Gift Card Promotion ("Promotion") being conducted by Florida Power & Light Company (“FPL”). This Promotion begins on Friday, March 19, 2010, at 12:01 AM (EDT) and ends on Friday, April 9, 2010, at 11:59 PM (EDT) or until all Gift Cards have been awarded (the "Promotion Period."). The clock on FPL’s Web site will be the official timekeeper for this Program. THIS GIFT CARD PROMOTION IS VOID WHERE PROHIBITED BY LAW OR REGULATORY ORDER BY THE FLORIDA PUBLIC SERVICE COMMISSION. YOU HAVE NOT YET WON, AND ENROLLMENT IN FPL'S E-MAIL BILL PROGRAM DOES NOT GUARANTEE OR INCREASE YOUR CHANCE OF WINNING.
ELIGIBILITY: NO PURCHASE OR PAYMENT IS REQUIRED BY YOU FOR ENTERING, WINNING OR REGISTERING FOR ANY PAYMENT PROGRAM OR THIS PROMOTION. THIS PROMOTION IS NOT OPEN TO THE GENERAL PUBLIC. DO NOT PROCEED IN THIS PROMOTION IF YOU ARE NOT AN FPL CUSTOMER. This Promotion is open only to FPL’s customers as of March 19, 2010, who are 18 years of age or older at the time of entry and a legal resident of the United States (excluding Puerto Rico, Guam and the U.S. Virgin Islands), who have received a bill insert from FPL requesting his or her participation in the Promotion or have automatically been entered by participating in one of the other Billing Program Promotions. Employees of FPL, its respective subsidiaries, affiliates, reward or Prize suppliers, and advertising and promotion agencies, including Administrator, and their immediate families (spouse, parents, children and siblings and their respective spouses) and individuals living in the same households of such employees are ineligible to participate.
TWO WAYS TO ENTER: (1) Fill out the bill insert and mail it in with your FPL payment. Originals only; no photocopies, please. (2) Click on the hyperlink in the FPL E-Mail Bill promotional bill insert and register to participate in the FPL E-Mail Bill® Program, a free electronic billing service (hereinafter referred to as the “Billing Program”). THE FIRST 300 VALID ENROLLMENTS WILL RECEIVE A $20 GIFT CARD ("Gift"). Once all available gifts have been awarded this Promotion will automatically expire and terminate. All registrations must be received by 11:59 PM (EDT) April 9, 2010 (or until all gifts have been awarded). LIMIT: Only one entry per FPL account number and only one entry per e-mail address. All registration/entries become the property of FPL and will not be acknowledged or returned. By entering into this Promotion, each entrant agrees to FPL’s use of his/her personal information as described in FPL’s Web site privacy policy (http://www.FPL.com/contents/privacy_policy.shtml) and in these Official Rules. In the event of any discrepancy between the privacy policy and these Official Rules, these Official Rules shall control and govern.
HOW TO RECEIVE A REWARD: The gift card will be awarded by mail to the first 300 FPL customers who register for the FPL E-Mail Bill® Program online. All awards will be under the direction of the Administrator, an independent judging organization, whose decisions are final and legally binding in all matters relating to the Promotion. Entries will be declared made by the authorized FPL account holder submitted at the time of entry. Any potentially winning entry may be required to provide FPL with proof that the potential winner is the authorized FPL account holder of the address associated with the potentially winning entry. AVAILABLE REWARD: Promotion odds are based on the total number of qualified entries received. Only the following gifts with registration listed below will be awarded in this Promotion:
NOTIFICATION OF RECIPIENTS: Each Gift recipient will be sent his or her Gift by mail or express service, whichever is appropriate. The Gift will be forfeited if the recipient is in non-compliance with these Official Rules or if selected potential recipient cannot be contacted, provides incorrect email or mailing address, is ineligible, fails to claim the Gift, or if the Gift notification or Gift is returned as undeliverable. In that event, no alternate winner will be selected. Acceptance of a Gift constitutes permission for FPL to use recipient’s name, voice, likeness, along with his or her address (city and state) and the right to use and publish their entries, proper name, and any statements made or attributed to such winner (collectively, the “Attributes”) in any and all media, unless prohibited by law. This will include but is not limited to media now known or hereafter devised, without notice, review or approval, in perpetuity and throughout the universe for advertising and promotional purposes in connection with the Sweepstakes without further compensation, and releases Sponsor from all claims arising out of the use of such Attributes.
BONUS SWEEPSTAKES: All entrants who register to participate in the FPL E-Mail Bill will automatically be entered into the FPL E-Mail Bill $5,000 Sweepstakes. This Sweepstakes began on Friday, Jan. 1, 2010, at 12:01 AM (EDT) and ends on Friday, Dec. 31, 2010, at 11:59 PM (EDT). Random drawing to select the Grand Prize $5,000 winner will be conducted on or about January 15, 2011. By entering this Promotion, you agree to be bound by these Official Rules. Potential winner of the $5,000 cash drawing will be notified by mail or express delivery following the drawing. Winner will be required to execute and return an Affidavit of Eligibility and Liability/Publicity Release within (10) ten days after notification is received. If the Prize or the Prize notification letter is returned as undeliverable or any non-compliance with the Official Rules or failure to respond and execute and return the appropriate forms within the applicable time period, it will result in forfeiture of the Prize and an alternate winner will be randomly selected from all eligible entries received. In the liability release, winner will agree to release FPL, and their respective parent corporations, officers, directors, employees and stockholders from any injuries, damages or losses of any kind including death that may arise out of the participation in this Sweepstakes or out of the acceptance, use, misuse or possession of the Prize. The odds of winning depend upon the total number of actual eligible entries received. All taxes on the Prize are the sole responsibility of the winner.
GENERAL CONDITIONS: ALL TAXES, FEES AND SURCHARGES ON THE PRIZE WON ARE THE SOLE RESPONSIBILITY OF THE WINNER. All entrants agree (i) to be bound by all applicable U.S. laws and regulations, as well as these Official Rules and the decision of the FPL and judges, which are final and binding on all matters relating to the Sweepstakes, (ii) to waive any right to claim ambiguity in the rules, and (iii) to release, indemnify and hold harmless FPL, and its respective affiliates, subsidiaries, agents, representatives, promotion and advertising agencies including the Administrator, and their respective employees, officers, directors, shareholders and agents (collectively, “Releasees”) from and against any injuries, losses, damages, claims, actions any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the Prize that may be awarded. Releasees are not responsible for printing or typographical errors in any Sweepstakes-related materials; for stolen, lost, late, misdirected, damaged, incomplete, inaccurate entries, or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes, or inability to access any Web site associated with this Sweepstakes, or process any transaction thereon. If in FPL’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and/or void any entries submitted fraudulently, to modify or suspend the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to award the Prize using all non-suspect entries received as of the termination date. Moreover, FPL reserves the right to rescind or change these Official Rules or the Sweepstakes at any time without notice. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, FPL RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Any attempts by an individual to access any Web site associated with this Sweepstakes via a bot script or other brute force attack or any other unauthorized means will result in the IP address becoming ineligible. Use of automated entry devices or programs such as by script, macro or any other automated means is prohibited and entries so generated are void. This Sweepstakes is conducted in English (which will be given its everyday ordinary meaning) and any and all disputes will be resolved in the appropriate state and federal courts in the State of Florida, exclusively, and subject to the laws of the State of Florida. Should there be a conflict between the laws of the State of Florida and any other laws, the conflict will be resolved in favor of the laws of the State of Florida.
