FPL uses the industry standard NAESB Base Contract for Sale and Purchase of Natural Gas (“NAESB Gas Contract”) as the legal basis for natural gas transactions. The NAESB Gas Contract is a copyrighted product protected by federal copyright law (reference: NAESB Copyright Policy).
EMT’s Natural Gas Contract, below, includes (a) selections from alternative provisions in the NAESB Gas Contract as designated in the Cover Page Selections document, and (b) additional provisions or amendments to the NAESB Gas Contract listed in the Special Provisions document.
Fuel suppliers must deliver gas capable of being transported by a pipeline serving the Florida market, such as: Florida Gas Transmission Company LLC (FGT) Gulfstream Natural Gas System LLC (GNGS), and at receipt or delivery points designated solely by EMT.
All natural gas contract documents referenced or provided below are subject to revision from time to time.
The “commercial” terms and conditions negotiated by the Fuel Trader and Fuel Supplier shall be defined in FPL’s Transaction Confirmation (transmitted separately to the Fuel Supplier by the Trade Confirmations Department) which identifies and incorporates, by reference, the specific contract executed between FPL and the Fuel Supplier, or alternately, in the absence of a signed contract, the Sept. 5, 2006, version of NAESB Gas Contract.
This document lists FPL’s preferred selections from among those alternative provisions available in and listed on page 2 of the NAESB Gas Contract.
This addendum contains both exceptions to the NAESB Gas Contract standard provisions and additional legal terms and conditions covering natural gas transactions between FPL and the fuel supplier.
